Terms of Service “Y.E.S”

1. General conditions

1.1. For the purposes of this document, the following terms are used with the following meanings:

• Service – Your Expert Service is further abbreviated as “Y.E.S.“
• User – an Internet user using the functionality of the “Y.E.S.” Service and its individual functions.
• Service – “Y.E.S.” is available at https://your-expert-services.com and on other resources, its partners and affiliates providing access to the functionality of the “Y.E.S.” service and its individual functions.
• Terms – these “Y.E.S.” Service Terms of Use published at https://your-expert-services.com.
• Regulatory documents – documents specified in clause 1.3. of these Terms.
• Contractor – a User who places an Announcement in the Service or who searches and views Orders to respond to.
• Service – work, sale, and delivery of goods in respect of which the User has placed an Announcement or an Order or has made a Response. When referred to in these Terms as “the provision of the Services,” it also refers to the performance of works.
• Announcement – a message published by the Contractor, addressed to an indefinite circle of persons, with a proposal to provide them with Services or published on the Service page and available to an indefinite circle of persons, the User’s Order with a proposal to provide him with the Service on the conditions specified in the message.
• Order – a message from the Customer about the need to provide the Service on the conditions specified in it. The Order may be published on the Service page and available to an indefinite circle of persons (in this case, the Order is an Announcement), or it can be sent through the functionality of the Service in relation to a specific offer of the Services (in this case, the Order is not an Announcement).
• Customer – a Service User who places an Order in the Service.
• Response – an invitation from the Contractor to the Customer to negotiate the provision of the Service, information about which is placed by the Customer in the Order placed in the Announcement and sent through the interfaces of the Service.
• Account – the User’s account in the Service.
• Public Profile – the page of the Contractor, available in the Service for an unlimited circle of persons, containing information about the Contractor, information about the Services provided by him, work experience, education, special marks of the Service, etc.
• Profile (personal account) – a section in the Service through which the Contractor can edit the Public Profile, upload Content, set other settings, and parameters for using the Service.
• Content – any text, photo, video materials uploaded by the User to the Service or automatically transferred by him to the Service (in particular, based on clause 3.7 of the Terms).

1.2. The service “Y.E.S.” invites the user to utilize the service provided under these terms and the terms of the regulatory documents.

1.3. The use of the Service is governed by these Terms, as well as the following documents:

• Privacy Policy “Y.E.S.“

1.4. Upon commencing the use of the Service or its individual functions, the User is deemed to have accepted these Terms, as well as the terms of the Regulatory Documents, in their entirety, without any reservations or exceptions. If the User disagrees with any of the provisions outlined in these documents, the User is not entitled to use the Service.

1.5. These Terms, as well as the aforementioned documents, are subject to change without any special notice. New editions of the Terms and Regulations come into effect from the moment they are posted on the Internet at the addresses specified in clause 1.1. and 1.3. of these Terms, respectively, unless otherwise provided by the new editions of the Terms and Regulations. The continued use of the Service after changes in the Terms or Regulations is considered an acceptance of their new editions.

1.6. In the event that “Y.E.S.” any changes were made to these Terms or the Regulatory Documents in the manner provided for in clause 1.5. The conditions with which the User does not agree, he is obliged to stop using the Service.

1.7. By using the Service, the User agrees to receive informational and/or advertising messages. The User has the right to refuse to receive messages by using the appropriate functionality of the Service or by following the instructions specified in the received message. The Service and the employees involved by it have the right to collect opinions and feedback from Users on various issues for statistical purposes, to control the quality of the Services provided, and also use the received data in an anonymized form for the operation of the Service. A survey of Users can be conducted by sending an information message or communicating using the contact information specified by the User in the Service.

2. Use of the Service. Separate functions of the Service

2.1. The Service provides a free functionality for placing, searching and viewing Ads and Orders of Users, searching for Contractors, Responses to Orders, as well as other functionality.

2.2. Part of the functionality of the Service may be available to the User when he goes through the registration procedure on the “Y.E.S.” services, in accordance with the conditions specified in the User Agreement of the “Y.E.S.” services. – The User may also be offered authorization using an account of third-party services that support integration with the ” Y.E.S.” Service. Using a third party service account, the User agrees to the processing “Y.E.S.” of the information provided by him in the account under the terms of the Privacy Policy in order to use the functionality of the Service. – Certain functions of the “Y.E.S.” Service may be available to the User who has not passed the authorization procedure.

2.3. The user who has passed the authorization procedure has the ability to create an Account in the Service, through which the User can create Ads and / or place Orders, and / or respond to Orders, add information to the Profile, edit the Public Profile, interact with other Users of the Service, etc. d. – It is not allowed to create several Accounts by the Contractor for posting Advertisements within the same category and/or subcategory of the Services. In the event that the User has additional Account(s) used to publish Announcements in one category and/or subcategory of the Services, the originally created Account(s) may be canceled(s). – When filling out the information in the Profile, the Contractor, who is an individual entrepreneur or legal entity, is given the opportunity to indicate the main state registration number in the Profile. At the same time, it is not allowed to create several Profiles with the same registration number, regardless of the degree of difference between the categories / subcategories of the Services provided or the place of their provision.

2.4. The Service provides an authorized User with the functionality of sending messages to another Service User who has placed an Announcement and/or an Order, as well as exchanging messages between the Contractor and the User in the course of searching for the Contractor and/or providing Services to the User. – In order to carry out quality control, including in order to verify the fact and conditions for the provision of Services to the User by the Contractor, as well as within the framework of complying with the requirements of the law, the “Y.E.S.” service stores the history of interaction between Users through the corresponding functions of the Service. Access to the “Y.E.S.” service and persons involved by it to such a story is possible for the specified purposes, as well as at the request of the participants in the interaction and in cases established by law.

2.5. The Service may provide authorized Users with the opportunity to publish reviews about the Contractor. The review must express the User’s subjective assessment of the Services provided to him and (or) the experience of interaction with the Contractor, and also contain the authentically stated factual circumstances of the experience of contacting the Contractor. – The user can publish a review anonymously, or “on his own behalf”. In the case of publishing a review “on his own behalf”, along with the review, his last name and first name, indicated by him in the “Y.E.S.” services account, as well as an image from his Public Profile page (avatar) and a link to his account page ( if applicable). – The Service has the right to establish its own criteria for assessing the reliability of a review and the possibility of its publication in the Service. Service “Y.E.S.” does not guarantee the publication of the review left by the User, as well as its placement within any period.

2.6. The Service may carry out due diligence of the Contractor (hereinafter referred to as the “Contractor’s due diligence”), based on the data (including passport data) provided by the Contractor when creating an Account in the Service or at the request of the Service. Verification may involve the use of open sources and databases, as well as the involvement of third parties. By providing his passport data, the Contractor gives his consent to the processing of his passport data by the “Y.E.S.” service, in order to conduct a due diligence check of the Contractor. – Based on the results of the Due Diligence of the Contractor, as well as in the event that the Contractor refuses to provide documents, the Service may refuse to provide the Contractor with access to the Service or its individual functions, without providing explanations as to the reasons for the refusal. The Service may also, at its discretion, place information about the successful verification of its documents next to the Contractor’s announcement. – Information about the due diligence of the Contractor is a reference. The “Y.E.S.” service does not guarantee the accuracy, completeness and accuracy of the result of the check and does not carry out the recommendations of the Contractors or additional guarantees regarding the quality of work / services or the actual reliability of the Contractor.

2.7. The “Y.E.S.” Service may provide for the possibility of automatically assessing the level of activity of the Contractor, determined based on the criteria established by the Service, such as: the frequency of Responses, work with Orders (confirmation of the agreement with the Customer on the Service, confirmation and closing of completed Orders), the quality of feedback from by the Customer (speed of response to Customers, the number of received or missed calls from Customers), the rating of the Contractor, determined on the basis of feedback from Customers, etc. – The indicator of the Contractor’s activity level is available in the Contractor’s personal account. The rating indicator of the Contractor is available to all Users of the Service.”

3. Use of the Service. Placing information in the Service

3.1. The Service provides the Contractor with the functionality of publishing an Announcement containing information specified by the User about himself, the Services he offers, the conditions for their provision, as well as the Content related to the content of the Announcement.

• The “Y.E.S.” Service may (but is not obliged to) make changes to the content of the Announcement if there are obvious errors and inaccuracies in the information posted by the User. In case of disagreement with the changes made, the User is obliged to immediately contact the support service of the Service with an explanation and justification of his position. – When filling out the Public Profile, the Contractor must select the Services he offers from the list with categories of Services posted on the Service. The User can add his category of Services only if such category is not in the list.

• The “Y.E.S.” Service has the right to make changes to the list of Services specified by the Contractor, if the Contractor has indicated already existing or similar Services.

3.2. The “Y.E.S.” Service provides the Contractors with the opportunity to post Responses to Orders placed by Customers in the Announcements on the Service. In case of posting a Response, the Customer receives an offer from the Contractor to enter into negotiations regarding the provision of the Service on the terms specified in the Announcement or on other terms specified by the Contractor. The Customer has the right to accept the offer of the Contractor, sent by him by posting a Response, to refuse it, or to continue agreeing on the conditions for the provision of the Services.

• When placing Responses by the Contractor, it is not allowed to abuse the functionality of the Service, including the use of any programs, bots that allow you to post Responses in automatic mode, as well as leaving Responses by the Contractor to Orders that are not related to the Services and / or the activities of the Contractor in accordance with information in the Service.

3.3. By placing an Announcement and/or a Response, the User guarantees that he/she is the person who has the right to post information with offers to provide him/her Services, as well as the right to provide these Services. The “Y.E.S.” Service has the right at any time to require the User to provide information and documents confirming the rights and powers for such actions. – In order to verify the accuracy of the information specified by the User in the Announcement, as well as for the purpose of assigning additional marks in the Public Profile / Announcements in the Service, the “Y.E.S.” Service may request identification documents of the User. The provided data is processed by the “Y.E.S.” Service under the terms of the Privacy Policy.

3.4. The User guarantees that he will place reliable, complete and up-to-date information in the Announcement, as well as independent and timely updating of the information provided by him.

• The “Y.E.S.” Service reserves the right to check the Announcements at any time and require the User to confirm the information specified in the Announcement, as well as request supporting documents in this regard, including the documents specified in clause 2.6. of these Terms.

3.5. By placing an Ad, the User agrees that the information provided by him, including contact details, the User’s image, Content will be available to an unlimited circle of people throughout the world.

• The “Y.E.S.” Service does not guarantee that such information can be used by third parties solely for the purpose of contacting the Announcement posted in the Service, and is not responsible for the actions of third parties to copy and process the information provided by the User for purposes not related to using the Service.

• The “Y.E.S.” Service may use the function of substituting the phone number specified in the Announcement to protect the User’s contact information from being used by an indefinite circle of persons for purposes not related to the use of the Service. The User can initiate communication using the spoof phone number specified in the Service. The User has the right to subsequently provide the person making the call to the spoof phone number with valid contact details for further communication in order to provide the Services.

• By posting contact details, as well as initiating a call using the specified data, the User agrees to record the “Y.E.S.” Service of the conversation and the phone number from which the call was made. Recordings can be used to control the quality of the Service, to develop and improve the Service or its individual functions, as well as to monitor compliance with the requirements of the Terms, consider complaints from Users and control the quality of the provision of Services by Contractors.

• By posting contact details, as well as initiating a call using the specified data, the User expresses his consent to the transfer of his last name and first name, specified by him in the “Y.E.S.” Services account, to the Contractor who posted the Announcement in respect of which the call is being made.

3.6. The Contractor undertakes to publish Announcements, carry out Responses and other actions through Service only in relation to the Services rendered by him personally. The Contractor is not entitled to impersonate another person, outsource the provision of the Services, act as an aggregator of the Services, resell, exchange orders received through the Announcements posted on the Service, both on a reimbursable and non-reimbursable basis.

3.7. The user independently and entirely bears all risks and responsibility for compliance with the law, content, completeness, correctness and reliability of the information and Content posted by him.

• It is forbidden to create an Announcement and / or post a review, Content and other information on behalf of another person, other misrepresentation regarding the identity of the User, his age, work experience, attitude towards third parties and organizations, etc.

• Using the capabilities of the “Y.E.S.” Service, the User is obliged to act in good faith and refrain from abusing the functionality of the Service.

• It is forbidden to use the “Y.E.S.” Service and its individual functions for the purpose of uploading, posting, transmitting, distributing advertising information, marketing mailings, spam, “letters of happiness”, materials containing viruses or other malicious computer codes, files or programs, implement fraudulent schemes using the functions of the “Y.E.S.” Service, and also use the Service solely to redirect Users to the pages of other sites.

• The “Y.E.S.” Service reserves the right, without warning and at its own discretion, to remove any Announcement, Content, other information published in the Service, and / or restrict the User’s access to the Service or its individual functions, including, in case if the actions of the User, the content of the Announcement, posted Content or other information is contrary to the laws of Thailand, these Terms, as well as the requirements of the Service for published materials.

4. Limitation of Liability

4.1. The Service is provided “as is”. The “Y.E.S.” Service does not guarantee that the Service meets the User’s goals and expectations, the uninterrupted and error-free operation of the Service as a whole and its individual functionality, in particular, the “Y.E.S.” Service has the right in any moment to completely or partially change the functionality provided by the Service.

4.2. The “Y.E.S.” Service does not guarantee the reliability, accuracy, completeness and quality of the information and Content posted on the Service, including their compliance with the law and respect for the rights of third parties. The “Y.E.S.” Service is under no circumstances responsible for the information and Content posted on the Service. The User must independently assess all risks associated with the use of information/Content, including an assessment of the reliability, completeness or usefulness, as well as their compliance with the law.

4.3. The “Y.E.S.” Service is not obliged to moderate, view, edit information, messages and Content posted within the Service, control over them, and cannot guarantee that information, messages and Content posted by the User within the Service do not violate the provisions of these Terms, legal acts, other documents. The User acknowledges and agrees that the “Y.E.S.” Service is not obliged to view information, messages, Content of any kind posted and / or distributed through the Service. The User is aware and agrees that he must independently assess all the risks associated with the use of information, messages and Content posted on the Service, including an assessment of their legality.

4.4. The “Y.E.S.” Service is not a participant in the legal relations established between the Users regarding the coordination and provision of the Services, including does not perform the functions of agency, mediation and representation in it (except for cases when between the “Y.E.S.” Service and the User, The “Y.E.S.” Service and the Contractor have concluded separate contracts/agreements establishing other conditions), is not responsible for the fulfillment of their obligations by the parties, and does not provide advice on legal, financial and organizational issues.

• Users undertake to independently resolve all disputes arising in connection with the conclusion and execution of a transaction regarding the offered and requested Services, including sending claims directly to the participant in such a transaction.

4.5. The “Y.E.S.” Service reserves the right, at its own discretion, to restrict the User’s access to the Service (or to certain functions of the Service, if technologically possible) using his account or to completely block the User’s Account if suspicious activity is detected in the Service, failure to pass the internal procedure moderation, violation by the User of these Terms or Regulations and in other cases, as well as to apply other measures to the User in order to comply with the requirements of the law or the rights and legitimate interests of third parties.

4.6. If there are reasonable assumptions about a possible violation of the law, the rights and interests of third parties by the Announcement posted on the Service, or by the actions of another User, the User can file a complaint about the content of the Announcement or the actions of another User using the feedback form. When sending a complaint, the User must indicate the reason why the Announcement or another User, in his opinion, may violate the law, the rights and interests of third parties. Based on the complaints received, the “Y.E.S.” Service has the right to take appropriate measures to eliminate the violation.

5. Other provisions

5.1. The “Y.E.S.” Service does not guarantee the safety of the data posted in the Service to any extent and / or for any period of time, including in the event of data changes due to the development or change of the Service.
The information provided by the User is processed under the terms of the Privacy Policy for purposes related to providing the User with the functionality of the Service, including to verify the information posted by the User in the Service, provide feedback on issues related to the use of the Service, and for other purposes specified in these Terms and the Privacy Policy.

5.2. Information and Content posted by Users in the Service can be used by the “Y.E.S.” Service in other services and applications of the “Y.E.S.” Service, as well as in advertising or marketing materials posted on the resources of the “Y.E.S.” Service on the Internet , as well as on other resources and sites on the Internet, to attract the attention of other users to the Service as a whole or to other applications and services “Y.E.S.“, goods, works and services of third parties, as well as indicating the name of the User who posted the information ( in this case, the name (pseudonym) of the User, which he indicated during registration or in the settings of his data in the corresponding section of the Service, will be indicated as the author’s name), and without it, without the need to obtain special permission from the User and without paying royalties, on the territory of all countries of the world without time limit, with the right for the “Y.E.S.” Service to grant the rights to use such information to third parties. At the same time, the User acknowledges and agrees that the “Y.E.S.” Service is not obliged to view such information, and its use in the specified ways for the specified purposes can be carried out automatically by software. If the User is not entitled to grant the “Y.E.S.” Service the right to use any information and materials in this way, he is obliged to refrain from posting such information.

5.3. Any information used in the “Y.E.S.” Service is intended solely for personal non-commercial use. At the same time, any copying of the information of the Service, including using automatic and other software tools for obtaining access to data, its reproduction, processing, distribution, bringing to public knowledge (publication) on the Internet, any use in the media and / or in commercial purposes without the prior written permission of the “Y.E.S.” Service is prohibited.

5.4. The User undertakes not to use the information and Content posted on the Service without the proper permission of the “Y.E.S.” Service or the User who owns this information/Content, in cases where such use is not related to the purposes of making and executing transactions. The User is prohibited from using the contact details of the Contractor or the Customer and the functionality of the Service to ensure communication with the User for the purposes of direct advertising or other distribution of unsolicited electronic messages, as well as for other illegal actions or actions performed without the knowledge and / or consent of the Contractor.

5.5. For questions and claims related to the use or inability to use the Service, as well as a possible violation of the law and / or the rights of third parties in the “Y.E.S.” Service, the User can send his appeal through the feedback form.

5.6. Relationships arising between the Customer or the Contractor and the “Y.E.S.” Service in connection with the use of the Service are not subject to consumer protection regulations due to the gratuitous nature of such relations.
